HRH CHIJIOKE NWANKWO FAILS IN COURT TO ESTABLISH THAT HE IS THE TRADITIONAL RULER OF NAWFIA TOWN.
Chijioke Nwankwo filed a suit at Neni high court on 18th December 2019 claiming that the court should declare that he is the Igwe of Nawfia town and he is therefore entitled to give his consent and approval before any cultural carnival or festival can be done by Nawfia people.
He also claimed that the court should grant injunction perpetually restraining the defendants from usurping his functions as the Igwe of Nawfia town unless with his consent and approval.
Being the party who went to court claiming to be the Traditional ruler of Nawfia town, the onus is on him to prove his case.
The case was heard by the learned trial Judge on 27th July, 2020, and reserved for judgement on the 8th of October 2020.
On 8th October 2020, the court delivered judgment and held that his case is fundamentally defective, invalid and a nullity; and further that his originating summons was signed by proxy and the court lacks jurisdiction to entertain it.
The court made an order striking out the case and awarded cost of #100,000 against Chijioke Nwankwo to pay to the defendants who are representing Nawfia people.
In effect, Chijioke Nwankwo failed to obtain from the court the declaration that he is the Traditional ruler of Nawfia town.
It is important to note that Nawfia people in the same suit categorically and unanimously stated that Chijioke Nwankwo is not the Igwe of Nawfia town and that at no time was he selected, appointed and installed as Igwe of Nawfia town and that the Governor of Anambra State did not recognize him as the Traditional ruler of Nawfia town.
It was therefore important for Chijioke Nwankwo to obtain from the court, a declaration in his favour that he is the traditional ruler of Nawfia town and that he is recognized by the Governor, these, he failed to achieve.
By the court making an order striking out his suit to be the Igwe of Nawfia town and refusing to grant the injunction he sought, plus ordering cost against him, Chijioke Nwankwo has failed to establish his claim to be the Traditional ruler of Nawfia Town.
Therefore, Nawfia people who denied him in court as their Traditional ruler are at liberty to select, appoint and install any person found suitable to occupy the stool of the Traditional ruler of Nawfia town and present the person to the Anambra State Government, for recognition.
- Nawfia people hereby thank God Almighty with profound joy, for giving the town victory in court which has gone a long way to reposition the town for greatness and progress.
Furthermore, Nawfia people express their appreciation to their illustrious son, Sir Barr. B.E.I Nwofor SAN for his high quality legal services and patriotic fervour constantly deployed at very crucial occasions over the years, in defence of Nawfia town and it’s people in all ramifications.
This is fake news. I have read the ruling in this case and it has nothing to do with the Igweship of IGWE Of Nawfia but on the sign/name of the lawyer consequently the case was struck out and His Highness is at liberty to file a fresh case which we are already working on
